My Car Insight Terms of Service
Welcome to My Car Insight! We are delighted to assist you in your search for the right vehicle. Before we begin, please read the following terms carefully. By engaging with our service and providing payment, you agree to these terms and conditions.
1.Overview
This agreement (“Agreement”) is between you, the customer (“Customer” or “you”), and My Car Insight, LLC (“MCI”), a Pennsylvania-based company. MCI provides vehicle research, identification, and negotiation services to assist you in finding and purchasing your desired vehicle.
By signing up for our services (the “Service”) you agree to the terms outlined here. This Agreement defines the scope of our services, your responsibilities, and the terms governing our relationship.
2.Services Provided
Upon payment, MCI will assist you by (dependent on level of service selected):
- Identifying vehicles within your budget and specifications.
- Coordinating test drives and dealership appointments.
- Search for and research the history of mutually selected preowned vehicles (For new vehicles, history research is not applicable)
- Advising on price negotiation, financing options, and extended warranties.
- Offering insights and our proprietary data to facilitate fair negotiations.
- Serving as an independent consultant without dealership affiliations or commission incentives.
- Assist with setting up pre-purchase inspections (PPI) and shipping if required*
Note: MCI does not certify, inspect, repair, or guarantee any vehicle’s condition or functionality.
*PPI and shipping are a separate expense to be paid by the customer directly with the selected service provider.
3.Customer Acknowledgments
You acknowledge and agree that:
- MCI’s role is advisory—decisions regarding vehicle purchase are entirely yours.
- MCI does not collect or process payments for vehicle purchases.
- MCI is not responsible for warranties, defects, or mechanical issues in the vehicles you select.
- MCI cannot guarantee the accuracy or completeness of information provided by sellers.
- You are solely responsible for signing contracts with sellers and arranging for financing.
4.Release and Liability Waiver
By engaging with MCI, you release MCI, its agents, employees, and advisors from all claims or liabilities related to defects or issues with any vehicle purchased through our assistance. You agree not to hold MCI accountable for any defect or misrepresentations by sellers.
5.Indemnification
You agree to indemnify and hold MCI harmless from any claims, damages, or expenses, including legal fees, arising from any disputes including but not limited to vehicle condition, taxes, or government fees associated with your purchase.
6.Payment Terms
- MCI accepts payments via major credit cards and ACH transfers.
- Full payment of the entirety of the selected plan is required to begin services.
- Payments are processed through a secure system chosen at MCI’s discretion.
7.Cancellation Policy
- Within 24 Hours (Before Advisor Assignment): A $35 cancellation fee applies to cover costs associated with terminating the agreement. The remaining amount will be refunded to your original payment method.
- After Advisor Assignment (Before Vehicle Approval): Once an advisor is assigned to the customer’s account, a $199 cancellation fee applies, and the remaining balance will be refunded. Customers will be notified via email once they are assigned and advisor. This process usually occurs within 1 business day of plan purchase.
- After Vehicle Approval: In the MCI process customers will verify the type/class of vehicle they are requesting assistance locating/negotiating. Once MCI verifies via email this step in the process no refunds will be provided.
8.Scope of Services
Once payment is confirmed, you will be directed on our website or via email to complete MCI customer checklists and make personal selections based on vehicle needs/wants. After submission, MCI will assign an advisor who will:
- Review your preferences and identify potential vehicles.
- Schedule test drives or viewings.
- Locate vehicles in predetermined geographical area. On preowned vehicles, will research vehicle history reports to include maintenance and repair history. MCI will also ask seller pertinent questions about the vehicles overall condition.
- Assist with negotiation and provide purchase guidance.
- Once a vehicle/s are agreed upon by the customer, MCI will begin the negotiation process to include asking for pricing on sellers’ vehicle and acquiring estimates on buyer’s trade-in. This process includes sharing details about the seller’s car as well as city/state/zip code. By entering into this process the customer is agreeing to allow MCI/advisor to acquire quotes on the vehicle they intend to trade in.
- Provide customers name/address/phone/email to seller once customer decides they want to move forward with purchase of car. MCI will then direct seller to the customer so deposit, if any can be set up and final meeting details can be arranged. MCI will not provide any of these identified details to the seller without first confirming with customer.
- MCI will then be available for consult while the customer is at the dealership completing their purchase.
- Once the customer enters the purchase process with the seller, MCI’s services are considered completed. Any further vehicle search/location process would require re-hiring MCI through the normal purchase process.
Note: Travel or shipping costs, if applicable, are your responsibility.
9.Change of Vehicle or Abandonment of Purchase
- If you change your selected vehicle after approval (outlined in 7(c) above), your initial payment will be retained, and an additional fee will apply to restart the process. The fee to restart the process will be a discount of 20% off the new selected service.
- If financing fails or you abandon the purchase, payments to MCI are non-refundable.
10.Customer Responsibilities
To ensure smooth service, you agree to:
- Complete all forms on MCI website or through email/call immediately after completing purchase of service. Provide accurate and timely information.
- Respond promptly to communications from MCI (your advisor). It is vital that the customer is prompt in their responses. MCI will contact customer throughout the process to include but not limited to the following:
- Listing of vehicle/s of interest (VOI). Customer should review and get back to MCI via email with selection/s of vehicles in which they have interest.
- Listing of VOI identified during MCI location process. Customer should promptly review the VOIs provided by MCI during this locating process and assess which, if any meet their criteria for potential purchase. Customer should make every effort to reply to advisor within 48 hours as pricing and inventory of vehicles changes frequently.
- Response to negotiated VOI prices received by MCI from sellers. Customer should make every effort to reply to advisor within 48 hours as pricing and inventory of vehicles changes frequently. This includes prompt responses to any offers received by MCI from sellers and shared with customers regarding the potential trade-in vehicle.
- If trading in a vehicle you assume responsibility for trade-in details and ensure transparency about the condition of the vehicle you are trading in and offers received from potential buyer. MCI is not liable for any difference between the amount you are offered by the seller prior to seeing your trade in person and the amount they provide once they inspect your vehicle.
- Once the customer decides on a vehicle they wish to purchase, MCI will put the customer in touch with the seller. The customer will then handle all final agreements with sellers and ensure compliance with relevant legal requirements. Customer will take care of deposits if any and setting a time to meet with the seller to inspect the vehicle and make final decision on purchase.
11.Dispute Resolution
- Governing Law: This Agreement is governed by the laws of Pennsylvania, USA.
- Venue: All disputes will be resolved exclusively in Pennsylvania state courts.
- Good Faith Resolution: MCI will attempt to resolve disputes amicably. If unresolved, either party may pursue legal remedies.
- Refunds in Disputes: Any refunds provided are goodwill gestures, not admissions of fault.
- Legal Fees: In case of legal action, the prevailing party may recover reasonable attorney fees and costs.
12.Final Approval
You retain the final decision on any vehicle purchase. MCI will not proceed without your explicit approval of the negotiated terms.
